Attorney & Author, Nicole Huberfeld, Professor of Health Law, Ethics & Human Rights, at Boston University School of Public Health, & Professor of Law at Boston University School of Law. Her work is at the intersection of Health law & Constitutional law, and the role of “federalism in health care” – which is the role of the states with regard to actions by the federal government. Professor Huberfeld often writes about Medicaid.
Discussion on the Affordable Care Act (ACA), also known as Obamacare; how States are faring that have implemented the Medicaid Expansion vs. states that have not. How absence of critical care units in hard-hit communities is affecting rural Americans due to hospital closures and lack of funding. The COVID-19 coronavirus pandemic has put an added strain on hospitals already struggling to care for Americans living in thee rural communities even for routine care, including Women's health, maternity, and others.
Also discussed, how some states are hiding the fact that they adopted some version of the ACA but under a pseudonym. Exploring the importance of healthcare availability in states that have fully expanded it, to those that have not.
Reviewed are Supreme Court rulings on ACA expansion, coverage, preexisting illness and issues affecting women. How deep-seated hostility to women's reproductive freedom is creating Health Care "deserts" across the nation. How a more uniformly expanded Healthcare Law such as Medicaid Expansion of the ACA can better serve both rural, and economically challenged populations, creating healthier communities across America--especially critical care in a time of COVID-19 coronavirus pandemic.
Prof. Huberfeld has authored numerous books and scholarly journal articles, including the first “new” casebook on health care law in a generation. Her work was cited by the US Supreme Ct, in the first Affordable Care Act case: NFIB v Sebelius. She has been published in national & int’l journals including: Stanford Law Review, NE Journal of Medicine, Yale Journal of Health Policy, Law & Ethics; and has also been interviewed by media outlets including: the Washington Post, New York Times & NPR.
